Стимулирование и его структура: проблема педагогического стимулирования формирования готовности будущих юристов к правотворческой деятельности

Abstract
В статье на основании последовательного изучения научных источников рассмотрено педагогическое стимулирование и его структура при формировании готовности будущих юристов к правотворческой деятельности. Авторы приводят мнения ученых и практиков по данному вопросу, анализируют его актуальность. Изучены виды стимулирования, к которым относится ценностное, педагогическое, психологическое, моральное, материальное, активное и пассивное стимулирование, прямое или опосредованное. Оно направлено на стимуляцию, например, психических познавательных процессов (ощущения, восприятия, памяти, воображения, мышления, внимания и т.д.), совершения определенных действий или освоения заданной информации, отработки практических заданий. Подробно рассмотрена структура готовности к правотворческой деятельности, которую необходимо сформировать у будущих юристов в процессе обучения в образовательной организации высшего образования. Отмечено, что педагогическое стимулирование происходит в определенных условиях (педагогические условия: использование в образовательном процессе педагогической технологии знаково-контекстного обучения; конструирование модулей решения типовых профессиональных правотворческих задач; уточнение программы и направленности войсковой стажировки и юридической практики на решение типовых профессиональных правотворческих задач; создание педагогического сопровождения стимулирования формирования готовности к правотворческой деятельности), (психологические условия: стимулирование мотивации субъектов образовательной деятельности на формирование готовности к правотворческой деятельности; выявление психолого-педагогических особенностей стимулирования готовности студентов к правотворческой деятельности; комплексная диагностика психической готовности к правотворческой деятельности). Готовность будущих юристов к правотворческой деятельности предстает перед нами изоморфной самой правотворческой деятельности, однако при этом имеет свое специфическое эмоционально-коммуникативное и ценностно-смысловое содержание, обусловленное с одной стороны уровнем функционально-психомоторной готовности к решению правотворческих задач и соответствующим уровнем интеллектуально-творческих устремлений, основанных не только на кумулятивно накопленных знаниях и опыте, но и ценностном отношении к будущей профессии, с другой стороны она обусловлена эмоционально-волевым взаимодействием и коммуникацией одних субъектов носителей готовности к правотворческой деятельности с другими.
